1 Scope

These Terms and Conditions apply to all contests conducted by NatuGena GmbH, Münchener Str. 149, 85051 Ingolstadt (hereinafter “Organizer”). By participating, each participant agrees to these Terms and Conditions.
 
This contest is not affiliated with Instagram/Facebook. It is in no way sponsored, endorsed, or organized by Instagram/Facebook and does not give rise to any legal claims against Instagram/Facebook. All information related to this contest is provided exclusively by the Organizer.

Eligibility to Participate

2.1 Eligible to participate is any natural person acting in their own name who is at least 18 years old and has their place of residence in Germany, Austria, or Switzerland.

2.2 The Organizer reserves the right to exclude individuals from participation who violate these Terms and Conditions or who gain or attempt to gain an advantage over other participants through unfair influence or manipulation of the contest. In such cases, the Organizer may also subsequently exclude participants from the contest, revoke prizes, and reclaim them.

2.3 Participation is only possible within the period specified in the contest description. Each participant may participate only once in an identical contest.

2.4 Employees of the Organizer and employees of companies involved in the implementation of this contest are excluded from participation.

Conduct of the Contest

3.1 A prerequisite for participation in the contest is following the Organizer’s Instagram or Facebook channel. Should additional requirements be necessary to participate in the contest, these will be communicated directly at the point of participation. The contest will be conducted during the specified period. All participants who meet the requirements set out in Sections 2 and 3 by the time of the respective draw will be considered. Immediately after the end of the participation period, the winner will be selected at random from among the participants.

3.2 The prize may not be changed or paid out in cash. The prize is non-transferable. Legal recourse is excluded

Prize Handling

4.1 The winner will be notified by the Organizer in a comment beneath the post. Each participant so notified is obliged to inform the Organizer within one week of sending the notification whether they accept the prize and to which address it should be sent. No shipping costs will be charged. If the Organizer does not receive a corresponding message within this period, the entitlement to accept the prize will lapse, and the Organizer reserves the right to determine another participant and notify them accordingly.
 
4.2 If the contact details provided by the participant are incorrect (e.g. an incorrect email address), the Organizer is not obliged to determine the correct details. Any disadvantages arising from the provision of incorrect contact details shall be borne by the participant.

Liability for Defects

The Organizer shall only be liable for damages incurred by the winner due to material and/or legal defects in cases of fraudulent intent, intent, or gross negligence. In all other respects, liability for material and/or legal defects is excluded.

Premature Termination, Adjustment, or Modification of the Contest

The Organizer is entitled to terminate, adjust, or modify the contest at any time without prior notice and without stating reasons if the proper conduct of the contest cannot be guaranteed for technical or legal reasons without corresponding measures.

Applicable Law

All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany. For consumers, this choice of law shall apply only insofar as the protection afforded is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence

Data Protection

The party responsible for data processing in connection with the contest is:

The designated controller is jointly responsible with Instagram (platform operator: Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) for data processing on the Instagram fan page and Facebook fan page on which the contest is conducted, pursuant to Art. 26 GDPR.

8.1 Processing of Your Personal Data in the Context of the Contest

We process your personal data for the proper execution and handling of the contest, particularly for sending the prize.

For the execution of the contest, the profile name and, if available, the first and last name of each participant are collected and stored. For sending the prize, we additionally collect the winner’s first and last name and address and forward this data to a shipping company commissioned by us. No further transfer of your data to third parties takes place.

The legal basis for this processing is Art. 6(1)(b) GDPR (performance of pre‑contractual measures and fulfillment of a contract).

If we publish the winner’s first and last name separately on our profile or fan page, or externally (e.g., in our online shop), this will only occur with the winner’s prior explicit consent pursuant to Art. 6(1)(a) GDPR

8.2 Storage Period

After the contest ends, your personal data processed in connection with the contest will be deleted no later than three months after the end of the contest, unless a valid consent for further processing exists (e.g., for newsletter distribution) and/or we have a legitimate interest in continued storage.

8.3 Your Rights

Under applicable data protection law, you have the following rights:

  • Right of access (Art. 15 GDPR): You have the right to obtain information about the personal data we process about you, the purposes of processing, categories of data, recipients, storage duration, rights to rectification, deletion, restriction, objection, complaint, the origin of your data, the existence of automated decision‑making including profiling, and any safeguards for data transfers to third countries.

  • Right to rectification (Art. 16 GDPR): You have the right to request immediate correction of inaccurate data or completion of incomplete data stored by us.

  • Right to erasure (Art. 17 GDPR): You may request deletion of your personal data under the conditions of Art. 17(1) GDPR. This right does not apply if processing is necessary for freedom of expression, legal obligations, public interest, or the establishment, exercise, or defense of legal claims.

  • Right to restriction of processing (Art. 18 GDPR): You may request restriction of processing if the accuracy of your data is contested, if you refuse deletion and request restriction instead, if we no longer need the data but you require it for legal claims, or if you have objected and the balancing of interests is pending.

  • Right to notification (Art. 19 GDPR): If you have exercised your right to rectification, deletion, or restriction, we must notify all recipients to whom your data was disclosed, unless this is impossible or involves disproportionate effort. You have the right to be informed about these recipients.

  • Right to data portability (Art. 20 GDPR): You have the right to receive your personal data in a structured, commonly used, machine‑readable format or request its transfer to another controller, where technically feasible.

  • Right to withdraw consent (Art. 7(3) GDPR): You may withdraw your consent at any time with effect for the future. Processing carried out before the withdrawal remains lawful.

  • Right to lodge a complaint (Art. 77 GDPR): If you believe that the processing of your personal data violates the GDPR, you may lodge a complaint with a supervisory authority, particularly in your place of residence, workplace, or the place of the alleged infringement.
